Terms and conditions

Terms and Conditions: Short-Term Rental Agreement and Guest Store Terms

THE PARTIES

These terms apply to all bookings made directly with Louise Thompson & Co Pty Ltd, ABN 82 605 956 349 (the Host), and to all guests staying at a property operated by the Host (the Guest). The property, dates and number of guests for each booking are set out in the booking confirmation.

THE PREMISES

The Host agrees to provide, and the Guest agrees to rent, the property set out in the booking confirmation, hereinafter known as the Premises.

LEASE TERM

The Guest may occupy the Premises from the check-in time on the check-in date until the check-out time on the check-out date shown in the booking confirmation (the Lease Term).

BOOKING

(a) The booking is confirmed when the Host communicates to the Guest that the booking has been accepted.

(b) The booking is not confirmed until:

(i) the Host has received a 50% deposit of the accommodation fee, for arrivals 30 days out or longer; or

(ii) the Host has received the accommodation fee in full, for arrivals within 30 days; and

(iii) the Guest has agreed to the terms of this Agreement in the manner prescribed by the Host.

(c) Once the booking is confirmed, the Host grants the Guest a licence to use the Premises subject to the terms of this Agreement.

(d) Photo identification must be uploaded as part of online check-in.

HOUSE RULES

By accepting this Agreement the Guest agrees to the following at all times:

No smoking or vaping anywhere inside the Premises

No candles, incense or other open flames indoors

Strict no-party policy. If you are in any doubt about this, contact the Host before booking

No visitors beyond the guests named on the booking without the Host's prior agreement

Respect the neighbours by keeping noise to a minimum during quiet hours

Report any breakage or damage

Do not move furniture between rooms or take indoor furniture outside

Secure the Premises when leaving, including closing windows and locking doors

Keys, lockbox codes and door access codes are issued to the Guest and must not be shared with any other person

Photo identification must be provided during online check-in

The person making the booking must be at least 25 years of age and must be one of the occupants. The Host may waive this at their discretion. This applies to the person booking and does not restrict the ages of other occupants.

The person making the booking is responsible for the conduct of every occupant and visitor

Neighbouring residences. Terra de Sol and The Tonic are ground-floor apartments with a separate residence directly above. Guests are asked to be particularly mindful of noise at night and in the early morning.

Parking. Parking arrangements differ by property and are set out in the guest guide. Guests must use only the parking allocated to their booking and must not obstruct neighbouring bays, driveways or access. Vehicle washing, servicing or repairs must not be carried out at any property.

CHECK-IN

(a) Guests may check in from 3:00pm on the check-in date. For single-room bookings at The Mooring, check-in is from 2:00pm.

(b) Early check-in may be available depending on the cleaning schedule and the previous booking. Where the Host is able to offer it, a fee may apply at the Host's discretion.

CHECK-OUT

(a) Guests must check out by 10:00am. For single-room bookings at The Mooring, check-out is by 11:00am.

(b) Late check-out may be available depending on the following booking. Where the Host is able to offer it, a fee may apply at the Host's discretion.

(c) Where a Guest does not vacate by the check-out time without prior arrangement, the Host may charge a late check-out fee.

QUIET HOURS

Quiet hours run from 10:00pm to 7:00am Monday to Saturday, and from 10:00pm to 9:00am on Sundays and public holidays. These hours apply at all properties.

During these hours there is to be no music, and all audio kept at a minimum out of respect for surrounding residents and, at The Mooring, for other guests in the house. This includes noise in outdoor areas.

OCCUPANTS

The total number of people staying at the Premises during the Lease Term must not exceed the number of guests shown in the booking confirmation.

At The Mooring, occupancy is limited to two persons per bedroom and eight persons in total at the property at any time, whether booked by room or as a whole house. The total of eight includes every occupant of any age, including children and infants.

If more than the authorised number of guests are found at the Premises, this Agreement is subject to termination by the Host.

THE MOORING: SINGLE-ROOM BOOKINGS

The following applies only to Guests who have booked an individual room at The Mooring, and not to whole-house bookings.

(a) The Guest has exclusive use of the booked room and its ensuite. Other rooms in the house may be occupied by other guests at the same time.

(b) The kitchen is not included in a single-room booking.

(c) The following outdoor areas are shared and available to all guests: the front porch, the fire pit courtyard, the lawn dining setting, and the rear patio.

(d) Guests are asked to be considerate of others in the house at all times, and particularly during quiet hours.

(e) Whole-house bookings include the kitchen and exclusive use of the entire property.

(f) Parking. One vehicle is permitted for each bedroom booked. Parking is in the driveway, arranged in two rows of two. Each booking is allocated a position, confirmed at the time of booking and in the guest guide. Because vehicles are parked in tandem, Guests are asked to coordinate vehicle movements with other guests in the house, and to do so quietly. Guests must not park across the crossover or in any way that obstructs a neighbouring property.

THE MOORING: FIRE PIT

The fire pit is a shared facility available to all guests at The Mooring, whether booked by room or as a whole house. Use of the fire pit is at the Guest's own risk and subject to the following:

(a) The fire pit must be supervised by an adult at all times and must never be left unattended while alight.

(b) Only the firewood provided may be burnt. No rubbish, no accelerants, and no other materials.

(c) The fire pit must not be moved from its hearth.

(d) The fire must be fully extinguished before guests retire for the night or leave the property.

(e) The Guest is responsible for the conduct of anyone in their party using the fire pit, and indemnifies the Host against any claim arising from its use.

(f) The Host may prohibit use of the fire pit at any time, including during a total fire ban or period of elevated fire danger, and the Guest must comply with any such direction and with any restriction imposed by the relevant authority.

BOOKING FEES

The Guest shall pay the Host the amount detailed during the booking process.

UTILITIES

The Host is responsible for all utilities and services to the Premises.

PAYMENT

(a) Bookings made through a third-party website: no security deposit is required.

(b) Bookings made directly with Louise Thompson & Co: a security deposit applies to whole-house bookings only. The amount varies by property and is shown during the booking process. No security deposit is required for single-room bookings at The Mooring. The deposit is held as a pre-authorisation against the Guest's card, is not charged unless a claim is made against it, and is released within 3 days of check-out less any itemised deductions. The deposit is not credited towards the accommodation fee.

(c) Where the Guest purchases mini bar items, optional extras, add-ons or experiences through the Host's guest store, payment is taken at the time of purchase through the Host's payment provider, and the Guest Store Terms below apply to that purchase.

(d) Nothing in this Agreement prevents the Host from claiming compensation from the Guest in relation to any breach of this Agreement or any damage to the Premises, and the Guest's liability is not limited to the amount of any security deposit.

(e) The Guest acknowledges they may be liable to the Host for any loss or damage the Host suffers as a result of the Guest's use of the Premises.

PETS

Pets are welcome at The Sapphire House, Terra de Sol and The Tonic.

Pets are not permitted at The Mooring. Assistance animals are permitted at all properties as required by law, and must not be left unattended at the Premises at any time.

Where pets are permitted:

(a) The Guest shall pay a pet fee as detailed during the booking process.

(b) All droppings must be removed from the Premises before departure.

(c) Pets must not be allowed on the furniture.

(d) The owner is liable for any damage caused to the Premises or any resulting loss.

(e) It is the Guest's responsibility to ensure their dog is suitably restrained within the yard and any common areas.

(f) A barking or aggressive dog will not be tolerated and may result in termination of the booking with no refund.

Where pets are not permitted, or an undeclared pet is found at the Premises, this Agreement may be terminated. The Guest is liable for the actual cost of any additional cleaning or repair required as a result, including but not limited to upholstery and carpet cleaning, and the Host will provide an itemised account of those costs.

Any breach of the above gives the Host the right to request immediate vacation of the Premises without refund.

SMOKING

Smoking and vaping are prohibited inside all properties.

The Mooring is a smoke-free property. Smoking and vaping are not permitted anywhere at The Mooring, including all outdoor areas.

Where a Guest smokes or vapes in breach of this clause, the Guest is liable for the actual cost of returning the property to its original condition, and the Host will provide an itemised account of those costs.

PERSON OF CONTACT

The Host can be contacted at:

Name: Louise Thompson

SUBLETTING

The Guest does not have the right to sublet the Premises.

INSPECTION AND ENTRY

The Host may need to enter the Premises during the Guest's stay if there are reasonable grounds, such as a report of a disturbance or a concern that house rules have been breached. The Host will always make every effort to contact the Guest first and resolve the matter directly. If the Host is unable to reach the Guest, or the situation cannot be resolved otherwise, the Host reserves the right to enter without prior notice. If any term of this Agreement is breached, the booking may be ended immediately and without refund.

MAINTENANCE AND REPAIRS

The Guest shall keep the Premises in good, clean condition and use it only in a careful and lawful manner. The Guest shall leave the Premises ready to rent at the end of the Lease Term, meaning immediately habitable by the next guest. The Guest shall pay for maintenance and repairs if the Premises is left in a lesser condition.

RUBBISH

(a) The Guest shall dispose of all waste generated during the Lease Term in accordance with the Host's instructions.

(b) The Guest agrees to put the bins out for collection the night before, and to bring them back onto the property once emptied, or by 6:00pm on collection day. The Host provides directions in the guest guide. If in doubt, contact the Host.

(c) From time to time the bins may be full or partly full due to the council collection cycle. This is outside the Host's control. Any rubbish that cannot be placed in the bin for collection must be taken away by the Guest on departure. Excess rubbish, as determined by the Host, will incur a removal fee of $250 to cover tip fees and labour.

QUIET ENJOYMENT

The Guest is expected to behave considerately towards neighbours and other residents of the immediate area. Creating a disturbance through large gatherings or parties is grounds for immediate termination of this Agreement.

HOST'S LIABILITY

The Guest and any of their guests indemnify and hold harmless the Host against any claims of personal injury, property damage or loss arising from use of the Premises, regardless of the nature of the accident, injury or loss. The Guest expressly acknowledges that any insurance the Host maintains on the property does not cover the Guest's personal property, and that the Guest should arrange their own insurance if such cover is desired.

Nothing in this clause excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law or any other legislation which cannot lawfully be excluded or limited.

LEGAL COSTS

The Guest agrees to pay all reasonable costs, legal fees and expenses incurred by the Host in enforcing this Agreement.

USE OF PREMISES

The Guest shall use the Premises for residential purposes only. The Guest is not authorised to sell products or services at the Premises or conduct any commercial activity.

ILLEGAL ACTIVITY

The Guest shall use the Premises for lawful purposes only. Any other use, including but not limited to illicit drug use, or verbal or physical abuse of any person, shall cause immediate termination of this Agreement with no refund.

LOST PROPERTY

Any personal items left at the Premises are not the responsibility of the Host. The Host will make every reasonable effort to return the item to the Guest at the Guest's expense. If a claim is not made within two weeks of check-out, the Host may dispose of the item.

CANCELLATION BY GUEST

(a) Bookings made through a third-party website (Airbnb, Booking.com, Vrbo, Stayz and similar): the cancellation policy of that website applies. To cancel, the Guest must contact the Host through the website where the booking was made. Refunds are given according to that website's policy, less any fees and charges incurred such as credit card and payment processing fees.

The policies applying to each property vary by platform and by whether the booking is for a whole house or an individual room. The policy that applies to your booking is the one displayed on that platform at the time you booked, and is shown in your booking confirmation.

(b) Bookings made directly with Louise Thompson & Co: 100% refund if cancelled at least 14 days before arrival, less any payment processing fees. Where a booking is cancelled within 14 days of arrival, no refund is payable. This applies equally where the Guest does not arrive.

Travel insurance is always recommended to cover unforeseen last-minute cancellations.

CANCELLATION BY HOST

In the unlikely event the Host has to cancel or alter a booking, for example due to fire or other damage to the property, the Host will:

(a) advise the Guest at the earliest opportunity; and

(b) make all reasonable efforts to accommodate the Guest, on terms acceptable to the Guest, at any other property the Host owns or manages, or on any other dates the property is available; and

(c) if unable to accommodate the Guest under the preceding clause, refund to the Guest all money paid under this Agreement.

BREACH AND TERMINATION

(a) Any breach or anticipated breach by the Guest of any term of this Agreement permits the Host to enter the Premises, cancel or alter the booking, and remove the Guest from the Premises.

(b) Where a booking is cancelled or the Guest is removed from the Premises under this clause, the Guest is not entitled to a refund of any money paid under this Agreement.

ISSUES WITH THE PROPERTY

(a) If there is a problem with the Premises, the Guest should contact Louise Thompson on 0417 913 893 or louise@louisethompson.biz.

(b) The Guest is not entitled to a refund where problems are outside the Host's control, or where they depend on contractor availability. This includes but is not limited to television, audio equipment, refrigeration, wi-fi, other appliances, plumbing, electrical systems and lighting.

PRIVACY

Personal information provided by the Guest, including identification, is collected only to manage the booking, verify identity and meet legal obligations. It is not sold or shared except with service providers needed to process the booking and payment. Records are kept for as long as required for business and legal purposes, including tax obligations. Privacy enquiries can be sent to louise@louisethompson.biz.

GUEST STORE TERMS

(a) Application. These terms apply to all purchases made through the Host's guest store, which is hosted on Touch Stay. By placing an order, the Guest agrees to these terms.

(b) Who can buy. The store is available only to guests with a confirmed booking at a property operated by the Host.

(c) Ordering. The Guest selects items and completes the order by providing the required details and full payment. The Host may decline any order, including where an item is out of stock or there is a payment issue. If an order is declined after payment, the Guest will receive a full refund.

(d) Prices and payment. Prices are in Australian dollars. The Host is not registered for GST and prices do not include GST. Payment is by credit or debit card, processed by a third-party payment provider. The Host does not see or store card details. In the event of a pricing error or technical issue, the Host may cancel the transaction and refund any payment made.

(e) Mini bar. Mini bar items are supplied on an honesty basis. Where the Guest takes an item from the mini bar, the Guest agrees to select and pay for it through the guest store before check-out. Items are subject to availability and are restocked between stays.

(f) Pre-ordered items and services. Items and services ordered in advance, such as breakfast baskets and extra cleaning, must be ordered at least 48 hours before they are required and are delivered to or provided at the Premises. If a pre-ordered item or service is delayed or unavailable, the Guest will be notified and offered a full refund.

(g) Cancellations and refunds. The Guest may cancel a pre-ordered item or service up to 48 hours before it is due for a full refund. Refunds are processed within 5 business days to the card used for purchase. Mini bar items that have been opened or consumed, and perishable items once delivered, are not eligible for a change-of-mind refund.

(h) Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Our services also come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Guest Store Terms limits those rights.

(i) Liability. To the extent permitted by law, the Host is not liable for indirect or consequential loss arising from a store purchase, and the Host's total liability for any item or service is limited to the price paid for it.

(j) Food and allergies. Pre-packaged products are labelled by their manufacturer, and the Guest should check packaging for ingredients and allergens. Prepared items such as breakfast baskets may contain, or be prepared alongside, common allergens including nuts, gluten, dairy and eggs. The Guest should contact the Host before ordering if they have an allergy or dietary requirement. The Host cannot guarantee any item is free from allergens.

(k) Products sold by others. The store may include links to products sold by third parties. Any purchase made through those links is made directly with that seller and on its terms, and the Host is not responsible for those products.

(l) Store platform. Touch Stay is not a party to any sale between the Guest and the Host.

(m) Changes. The Host may update these terms at any time. The terms in place when an order is placed apply to that order.

GOVERNING LAW

This Agreement, including the Guest Store Terms, is governed by the laws of Western Australia, and the parties submit to the jurisdiction of the courts of Western Australia.
